These Terms of Service (“Terms”) govern your access to and use of the Tito Signature website, online store, products, services, and related features.

The website and online store are operated by Tito Signature Food Trading FZ LLC, United Arab Emirates (“Tito Signature”, “we”, “us”, or “our”).

By accessing our website, creating an account, placing an order, or purchasing any of our products, you agree to these Terms of Service and our Privacy Policy.

If you do not agree with these Terms, please do not use our website or services.

1. ELIGIBILITY AND CUSTOMER ACCOUNTS

You must be legally capable of entering into a binding agreement under the laws applicable to you in order to make purchases through our store.

When creating an account or placing an order, you agree to provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality and security of your account and for all activity conducted through your account.

You must notify us promptly if you believe your account has been accessed or used without authorization.

2. PRODUCTS

Tito Signature offers chocolate, confectionery, sweets, gift products, and related food products.

We make reasonable efforts to display and describe our products accurately. However, actual colors, appearance, packaging, decoration, size, or presentation may vary slightly from images displayed on the website.

Product packaging, ingredients, designs, availability, and specifications may be updated or changed without prior notice where permitted by law.

3. FOOD INFORMATION AND ALLERGENS

Our products may contain or come into contact with allergens, including but not limited to:

Milk, dairy products, nuts, peanuts, pistachios, hazelnuts, cashews, pecans, macadamia nuts, sesame, wheat, gluten, and soy.

Customers with food allergies or intolerances should carefully review the ingredient and allergen information provided on the product packaging before consumption.

If you have a serious allergy or require additional ingredient information, please contact us before placing or consuming an order.

4. ORDERS

Placing an order through our website constitutes an offer to purchase the selected products.

An order is considered accepted once we confirm it and, where applicable, successfully receive or authorize payment.

We reserve the right, where legally permitted, to refuse or cancel an order due to reasons including product unavailability, incorrect pricing, suspected fraud, payment issues, technical errors, or delivery limitations.

If we cancel a paid order, any amount due for refund will be returned using the applicable payment or refund method.

5. PRICES AND PAYMENT

All prices are displayed in United Arab Emirates Dirhams (AED) unless otherwise stated.

Applicable taxes, including VAT where required, will be displayed or included in accordance with applicable UAE law.

Delivery charges, if applicable, will be shown during checkout before the customer completes the order.

We reserve the right to change prices, promotions, discounts, and offers at any time. Such changes will not normally affect orders already confirmed.

Payments are processed through Shopify and/or authorized third-party payment providers.

6. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional conditions, including validity periods, minimum purchase requirements, eligible products, and usage limitations.

Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other promotions.

We reserve the right to cancel or refuse the use of a promotion where we reasonably believe it has been misused or obtained fraudulently.

7. SHIPPING AND DELIVERY

We deliver to locations displayed as available during checkout.

Estimated delivery times are provided for convenience and may vary due to location, order volume, courier delays, weather conditions, public holidays, or circumstances beyond our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

Tito Signature will not be responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by the customer, subject to applicable law.

Because our products may include chocolate and temperature-sensitive food products, customers should receive and appropriately store delivered products as soon as reasonably possible.

8. STORAGE AND PRODUCT QUALITY

Customers should follow all storage instructions printed on the product packaging.

Chocolate and confectionery products should generally be protected from direct sunlight, excessive heat, moisture, and strong odors.

Tito Signature cannot guarantee product quality where products have been improperly stored or handled after successful delivery.

9. RETURNS, REFUNDS AND FOOD PRODUCTS

Due to the perishable and food-related nature of many Tito Signature products, returns or exchanges may be restricted for health, hygiene, and food-safety reasons, subject always to applicable UAE consumer protection laws.

This does not affect your rights where a product is defective, damaged, incorrect, unsafe, or otherwise qualifies for a remedy under applicable law.

If you receive an incorrect or damaged product, please contact Tito Signature as soon as reasonably possible and provide your order information and, where appropriate, photographs showing the issue.

Refunds, replacements, or other remedies will be handled in accordance with our Refund Policy and applicable UAE law.

10. ORDER CANCELLATIONS

If you wish to cancel an order, please contact us as soon as possible.

Once an order has entered preparation, processing, dispatch, or delivery, cancellation may no longer be possible, particularly for food products or specially prepared orders.

Any statutory rights available under applicable UAE law remain unaffected.

11. INTELLECTUAL PROPERTY

All Tito Signature branding, logos, characters, packaging designs, photographs, graphics, videos, product designs, written content, slogans, and other original materials displayed through our website are owned by or licensed to Tito Signature and are protected by applicable intellectual property laws.

They may not be copied, reproduced, modified, distributed, published, commercially exploited, or used without our prior written permission except where permitted by law.

12. CUSTOMER REVIEWS AND CONTENT

If you submit a review, photograph, comment, suggestion, or other content to Tito Signature, you confirm that you have the right to provide that content and that it does not violate the rights of another person.

You grant Tito Signature a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display such content for operating and promoting Tito Signature, subject to applicable law.

We reserve the right to moderate or remove unlawful, fraudulent, abusive, misleading, or inappropriate content.

Shopify provides the e-commerce technology used to operate the store. Purchases of Tito Signature products, however, are transactions between the customer and Tito Signature, except where expressly stated otherwise.

Tito Signature will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, governmental actions, transportation disruptions, courier interruptions, telecommunications failures, or similar events.

The latest version will be published on our website together with the applicable update date.

Where required by applicable law, material changes will be communicated appropriately.

These Terms and your use of the Tito Signature online store are governed by the applicable laws of the United Arab Emirates.

Any dispute shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, subject to any mandatory consumer protection rights or jurisdiction requirements under applicable law.
